Contract Basics
Cosponsored by the ABA YLD Business Law Committee, the ABA YLD Law Practice Management Committee, and the ABA YLD Public Utilities, Transportation and Telecommunications Law Committee
Room: Salon A

Everyone, lawyers and non-lawyers alike, encounter contracts on a regular basis. If you buy a home, unless you purchase it outright, you sign a loan contract. If you rent a home, you sign a lease agreement. Before using software, you are asked to accept a licensing agreement.

Attorneys regularly enter into engagement agreements with their clients. Yet, you may still have lots of questions about contracts:

  • Another person reached an oral agreement with my client - can my client sue that person for breach of contract?
  • Can two contracting parties reach any agreement they want or are there limitations?
  • Are there certain provisions that should appear in every contract?
  • Exactly what does “boilerplate” mean, anyway?
  • What about provisions specific to certain types of contracts?

Come join us for answers to these questions and more.

Chris Fortier (Moderator), Attorney, Vienna, VA; Elizabeth A. Bleakley, Attorney, The Law Office of Elizabeth A. Bleakley, LLC, Chicago, IL; James L. Kopecky Attorney, James L. Kopecky, P.C., Chicago, IL and Harsharn K Makkar, Makkar Law Firm LLC, Duluth, GA

  • a basic overview of federal laws concerning healthcare fraud and abuse, including the Anti-Kickback Statute and the Stark Law

(Ethics) The Top 10 Things That Get Tax Lawyers in Trouble for Malpractice
Cosponsored by the ABA Tax Law Section
Room: Salon B

When the average tax practitioner thinks about a conflict, the conflict typically concerns the possible disqualification from a matter and perhaps even the need to disgorge fees or at least soothe the hurt feelings of an “abandoned” client. Those of a more sober mindset might also consider the possibility of a disciplinary proceeding. However, as the distinguished panelists will discuss, veteran legal malpractice defense lawyers know that a conflict – or an alleged conflict – can turn an otherwise defensible malpractice claim into a nightmare.

Matthew P. McLaughlin (Moderator), Attorney, Balch & Bingham LLP Jackson, MS; Christopher Rizek, Attorney, Caplin & Drysdale, Washington, DC ; Paul Koning, Partner, Hughes & Luce LLP, Dallas, TX and Joe Lundy, Attorney, Alas Loss Prevention Consultant, Rancho Mirage, CA
