VIEW FROM THE CHAIR
H. Wesley Sunu Chair, Excess, Surplus,
Lines, and Reinsurance Committee
This is my final report as Chair of the
ESLR Committee. The incoming leadership of the ESLR Committee will make sure that things
are taken care of from one coast to another. Michael Knoerzer, the Chair, is located in
New York and the Chair Elect, Linda Lasley, is located in California. Both Michael and
Linda will be putting together programs and projects for the committee. If you are
interested in helping out, and especially if you would like to work on a regional program,
contact either Michael or Linda.
I want to thank the Newsletter editor,
David Anderson, for all his hard work in putting out the Committee Newsletters. However,
you still need to keep sending your submissions for our Committee Newsletter. The new
Newsletter editor, is Deborah Prawiec, an attorney at CNA Re. The best way to send your
submissions is by e-mail attachment and her e-mail address is "Deborah.Prawiec@cna.com." If possible,
please use e-mail as the Newsletter is much easier to format when the submissions are in
electronic form.
For those of you who could not make it to
the annual meeting in New York and London, the mock trials, which were organized by
Michael Knoerzer, were highly educational and great fun to attend. It was interesting to
see the New York jury come back with a verdict that was completely opposite from the
judgment entered by the British judge in the London trial. Linda Lasley, our Chair Elect,
is considering programs for the annual meeting next year, which will be held in Chicago.
If you have any thoughts or ideas for next year's program, contact Linda.
Last, I want to thank Michael Fandel for
taking charge of the ESLR submission for the year-end review article. His hard work in
overseeing the article, which is published in the Tort and Insurance Practice Journal,
took a lot of time and hard work. However, it was is a great article and one that I have
used to update my research. Last, the best webmaster in all of TIPS is Larry Schiffer. He
is our webmaster and will continue to be our webmaster next year. If you have any
e-materials which you believe are appropriate for posting on our web page, send them to
him at "lschiffe@llgm.com."
One final note of news, TIPS did not come
out to support the use of MDPs (mutli-disciplinary practice) at the New York annual
meeting. The ABA took a vote and it also came out against MDPs. It was reported in the
National Law Journal that the American Bar Association's House of Delegates voted to
"preserve the core values of the profession" by encouraging state bar
associations and other agencies that regulate the legal profession to prohibit lawyers
from sharing fees with nonlawyers or transferring to nonlawyers ownership or control over
law firms. The 314 to 106 vote against MDPs, should be considered a blow to the Big Five
accounting firms, which have been expanding into the legal services market overseas and
hoping to do so in the United States.
