A Word from the Chair

It's hard to believe we are half-way through the TIPS 1997-1998 year. So much to do. Before any more time goes by, please be sure you have your reservations for ESLR's first-ever Mid-Year CLE Meeting in Scottsdale, February 19-21, 1998. As a co-sponsor of the Insurance Coverage Litigation Committee's Mid-Term Meeting, ESLR joins the Self Insurers and Risk Managers and the Appellate Advocacy Committees for a CLE program in a retreat setting. The entire program is outlined on the next page. From ESLR's perspective the presentations in "The Primary/Excess Relationship: Avoiding Bad Faith," "Admission of Extrinsic Evidence to Resolve Policy Ambiguities," "Allocation," "Policyholder Control of the Defense," and the Toolbox lunch are timely and especially relevant. Thanks to David Anderson for coordinating the panel on Extrinsic Evidence. I look forward to seeing you. Please join with me and the other Vice Chairs in a committee business meeting immediately preceding the program on Friday morning.

In addition to the planning for the Mid-Year meeting, other plans are being made. The TIPS Spring Meeting with YLS in La Jolla, California from May 14-17, 1998 has an impressive CLE and Professionalism Program. In addition to a focus on Technology, some of the topics to be presented are:

  • Mass Tort and Environmental Litigation: Practice Inside and Outside the Courtroom.

  • Hot Issues in Class Actions --is the Nationwide Class Viable; When Is a Defendant a ALimited Fund;@ May a Class Be Certified Only for Medical Monitoring; Who Do Mass Tort Classes Really Benefit?

In August, 1988 when we convene in Toronto, we will sponsor a CLE program entitled, "Corporate Counsel's Guide to Excess Insurance and Reinsurance." Tom Downey is charged with coordinating the speakers and papers. Tentatively, the program is set to follow our Committee Business Meeting on Saturday, August 1, 1998.

On other fronts, you really are missing some terrific updates if you are not on the Committee List Serve. Thanks to Webmaster Larry Schiffer, committee members will receive "News Flashes" of important developments. ESLR COMMITTEE TO HOLD BUSINESS MEETING AT THE INSURANCE COVERAGE COMMITTEE MID-YEAR MEETING IN PHOENIX, ARIZONA

The ESLR Committee will hold a Mid-Year business meeting in Phoenix, Arizona on February 19-21, 1998. This meeting will be held in conjunction with several continuing legal education programs jointly sponsored by ESLR, Insurance Coverage Litigation Committee and the Self Insurers and Risk Managers Committee. All committee members are encouraged to attend this meeting since plans for future committee programs will be discussed. TIPS SPRING MEETING WITH YOUNG LAWYERS' DIVISION

The 1998 TIPS Spring Meeting in La Jolla, California will be co-sponsored with the ABA's Young Lawyers' Division (YLD). There will be a large number of CLE programs to chose from, including several programs regarding the use of technology in the legal profession. The dates for this meeting are May 12-16, 1998. PLAN AHEAD FOR THE 1998 ANNUAL MEETING IN TORONTO

Now is the time to get registered for the ABA Annual Meeting in Toronto, Canada -- July 30, 1998 to August 5, 1998! The ESLR Committee has two outstanding CLE programs planned for this meeting. The first program, entitled: "Corporate Counsel's Guide to Excess and Reinsurance," will provide practical advise regarding new developments of excess insurance and reinsurance. The second program, entitled "Managing High Tech Risks in the Year 2000 and Beyond," will focus on risk and insurance issues developing in the technology industry, including the Year/2000 computer problem. More information regarding these programs will be sent directly to all members shortly. So don't miss this opportunity to get your preference on hotel rooms -- register today! ESLR COMMITTEE SUBMITS LONDON 2000 PROGRAM PROPOSAL

The ESLR Committee is one of several TIPS Committees that submitted a program proposal for the ABU Annual Meeting in New York and London in the year 2000. The TIPS London 2000 Coordination Committee will first review all program proposals. The TIPS Committee will then select the final programs to be submitted to the ABA Standing Committee for London 2000. The co-sponsors for this program include the Insurance Coverage Litigation Committee, the Self-Insurers and Risk Managers Committee, the International Tort and Insurance Committee, and the Public Regulation of Insurance Committee. ESLR MEMBERSHIP DIRECTORY

Contrary to popular belief, the ESLR Membership Directory is not dead, but merely delayed. The TIPS office is currently sorting and updating the committee membership data. All committee members should make sure that the TIPS office has accurate information regarding name, address, telephone number, facsimile number, and e-mail address. The latest projected date for completion of this project is February 1, 1998.

Please note:  If you are already a Tort Trial & Insurance Practice Section member, you may join up to three (3) committees at no additional cost. However, if you are not a Section member, you must join the Tort Trial & Insurance Practice Section first.
