The Tort Trial & Insurance Practice Section’s Fidelity and Surety Law Committee cordially invites you to join us in Baltimore this Fall on Friday, October 26, 2001 for the 2001 Fidelity and Surety Law Committee Fall Program entitled THE LAW OF PAYMENT BONDS.

The Fall Program, to be held in the brand new Baltimore Marriott Waterfront Hotel located on the beautiful Inner Harbor in the City of Baltimore, is an expanded version of the program concerning THE LAW OF PAYMENT BONDS presented at the Annual Mid-Winter Meeting of the Fidelity and Surety Law Committee in San Francisco, California on January 30, 1998. The course materials for the Fall Program will be the book entitled THE LAW OF PAYMENT BONDS, which will be updat-ed with a supplement linked to the existing chapters in the book.


The presentation of the Fall Program will include an in-depth review of the surety’s rights and obligations under the payment bond, including substantive issues such as the surety’s liabilities to various claimants, the types of claims covered, substantive proof requirements and notice requirements; procedural issues such as suit limitations, jurisdiction, venue and forum selection clauses; the defenses of the surety; the surety’s rights to the bonded contract funds; bad faith claims, bankruptcy and arbitration as they relate to claims against the payment bond; and the surety’s reimbursement rights to recover its payments.


The speakers and presenters at the Fall Program all have extensive experience in litigating and resolving payment bond claims and protecting the rights of the surety. The Fall Program course materials, including the book entitled THE LAW OF PAYMENT BONDS and the supplement, will be a welcome and useful addition to the library of every surety practitioner attending the Fall Program. The Fall Program will be of extensive value to in-house surety claims counsel and staff of all levels and ability, and young and not so young outside counsel for sureties who become involved in payment bond claim litigation and resolution.


In addition to the educational benefits of the Fall Program, there will be a Welcome Reception and Cocktail Party on Thursday night, October 25, 2001 from 5:30 p.m. to 7:30 p.m. at the Baltimore Marriott Waterfront Hotel, with dinner opportunities thereafter in Baltimore’s famous Little Italy, which is adjacent to the hotel, or any of Baltimore’s other fine restaurants, and the opportunity to get together with other fellow surety practitioners and experts in the field during the Friday breaks and lunchtime.


The Fidelity and Surety Law Committee Fall Program will be preceded on Thursday, October 25, 2001, by the annual meeting of the FIDELITY LAW ASSOCIATION, which will also take place at the Baltimore Marriott Waterfront Hotel. This is an excellent opportunity for you to attend both of these programs and satisfy your CLE requirements.
