Which Bond Form is Right for Me? Exploring the Differences between the AIA and ConsensusDocs Bond Forms

This program will look at bonding options under the American Institute of Architect (AIA) and ConsensusDOCS forms respectively, and focus on developments and trends in securing both performance and payment obligations on a variety of projects and project delivery systems.  Our panelists will take an interactive view which will focus on a comparison between the AIA and ConsensusDOCS bond forms and offer practical advice on industry and legal trends on suretyship.

The Psychology of Impasse in Negotiation and Mediation

Issues of “face,” self-esteem and self-identity form the psychological core of negotiation and mediation. Most important is the “IDR cycle” — the cycle of self-inflation (overconfidence), deflation and realistic resolution that parties typically experience during negotiation and mediation. This program will help you understand the IDR cycle, the psychological reasons for impasse, and how to prepare yourself and clients for dealing with impasse.

Guidelines for Working with Immigration and Customs Enforcement (ICE) During An I-9 Investigation

The Immigration Reform and Control Act (“IRCA”) prohibits employers from knowingly hiring or continuing to employ unauthorized workers. Employers are legally obligated to verify the identity and employment eligibility of new employees within the first three days of employment and to properly maintain these records. Emphasizing the administration’s commitment to ensuring compliance in this area, in July 2009, U.S. Immigration and Customs Enforcement (ICE) served 652 Notices of Inspection (NOIs) to employers nationwide. Companies were reportedly selected based on results of formal investigations and not merely on a random basis. Over time, most employers have learned that, even for the most conscientious, IRCA compliance is fraught with administrative pitfalls. This program is designed to promote an understanding of I-9 compliance best practices as well as guidelines for working with the government in the midst of an investigation. This concise presentation of “must-know” ICE enforcement and verification compliance minefields has been developed for employers, HR personnel, and in-house counsel and business and employment attorneys.

An International Perspective on Comparative Toxic Tort, Environmental and Product Liability Legal Systems

This program will provide an overview of comparative British, Canadian, French and German legal systems for litigating and adjudicating toxic tort, environmental law and products liability claims. The panel will be comprised of leading international toxic torts, environmental law and products liability practitioners with in-depth experience and invaluable insights. Each of the four speakers will speak for 15 to 20 minutes. The remainder of the time will be used for questions from the audience.
