SPY ACT and Spyware

Last year, the SPY ACT (Securely Protect Yourself Against Cyber Trespass Act) passed the House but failed in the Senate, reportedly due to enormous lobby pressure by the marketing associations. The SPY ACT has now been reintroduced in Congress by Rep. Mary Bono. The Act defines most functions performed by spyware as unfair business practices subject to Federal Trade Commission enforcement and fines. There will be several sessions at this year's ABA TECHSHOW dealing with the hot topic of spyware, including one on its use in family law cases.
