Legal Ethics and Technology: Multi-State Jurisdiction

Specifying Jurisdiction

Some states have rules about websites for out-of-state firms with offices in that state. Below are some examples of ethics opinions concerning restrictions based on geography available for free online.

Other state ethics opinions can be found on the advertising, online referral services, and confidentiality in the use of email pages.

  • Connecticut (Connecticut Bar Association: 97-29 10/22/97) The informal opinion states that the ethics advertising rules apply to web site advertising, but the applicability of Connecticut's rules on out-of-state advertisements by lawyers does not fall under the jurisdiction of the ethics committee.
  • Iowa (Iowa Supreme Court Board of Professional Ethics and Conduct/Iowa State Bar Association: 96-14, 8/29/96): The opinion states that if an out-of-state law firm advertises a branch office in Iowa, the advertisement must conform to the Iowa Code of Professional Responsibility for Lawyers and applies to a Web site as advertising. The firm may maintain separate Web sites for its Iowa and non-Iowa offices.
  • North Carolina (North Carolina Bar Association: RPC 241, 10/16/96): The opinion allows participation in an online attorney directory as long as the listing accurately reflects the geographic location of the attorney's office and the jurisdictions in which the attorney is licensed to practice.
  • South Carolina (South Carolina Bar Association: 94-27, 1994): This advisory opinion states that any advertisement for legal services disseminated by public media, including a Web site, must clearly identify the geographic limitations of the lawyer's practice.

Also, the ABA Center for Professional Responsiblity has a Commission on the Multijurisdictional Practice of Law. The site includes a report from a symposium help by the Commission in March 2000.
