It is my personal opinion that taxpayer consent to use or disclosure of tax preparation information should be limited to only those instances where it is necessary for tax-related purposes.  I believe the regulations should define what purposes are “tax-related.”

TAX HIGHLIGHT
NATIONAL TAXPAYER ADVOCATE NINA OLSON DELIVERS MAY MEETING KEYNOTE ADDRESS

WASHINGTON – In remarks to the Tax Section’s May Meeting plenary breakfast attendees, national taxpayer advocate Nina Olson addressed issues regarding the disclosure of taxpayer’s tax return information.  Her remarks noted recent IRS proposals that would change the regulations regarding how tax preparers may seek consent to use or disclose that information.  The stir around the new proposals has led to debate in the practitioner community about whether the proposed changes would go far enough to protect taxpayer privacy.

NEW GOVERNMENT SUBMISSIONS
The Tax Section routinely sends technical comments to federal agencies and legislators considering changes in tax regulations and policy.  Recent submissions of technical comments include:

  • Comments to IRS on proposed arbitrage provisions of Internal Revenue Code Section 148, relating to advance refunding escrows funded with proceeds of hedged bonds.
  • Comments to IRS addressing Internal Revenue Code Section 7874 proposed regulations dealing with inversion transactions.

SECTION'S TASK FORCE ON INTERNATIONAL TAX REFORM
The Tax Section’s Task Force on International Tax Reform has completed its white paper, providing objective criteria by which to evaluate tax reform proposals and identify and analyze possible modifications to U.S. international tax rules. The complete Report will appear in the Spring 2006 issue of The Tax Lawyer, and will be posted on the Tax Section web site.
