Section Presents Creation/Evolution Program in Chicago on February 9, 2006

The Section of Science & Technology Law is pleased to present the thought provoking program"Constitutional Principles and Legal Strategies in the Creation/Evolution Debates" on Friday, February 9th in conjunction with the ABA Midyear Meeting in Chicago.

 

There is currently a resurgence of debate over what should be taught as biological science concerning the origins and development of life.  Many of these disputes are moving from public debate to the courts. When courts are asked to resolve these debates, they do so not only in light of the scientific, philosophical and religious positions presented, but also with regard to legal precedents regarding separation of church and state in Constitutional law.  Litigation also introduces questions of strategy and tactics peculiar to the courtroom, but distinct from public policy debates.  This session will complement the scientific perspective by providing an overview of cultural and legal history, and then examine in detail legal doctrines and strategies which are now being applied.

 

CLE Credit has been applied for in all mandatory CLE states.  The program is complimentary for all Section members.

Section is Seeking a Liaison to ABA Task Force on Surveillance

The Section is accepting nominations for a liaison to serve on a newly created task force on surveillance. 

The Criminal Justice Section would like a liaison from the Section of Science & Technology law that has  expertise on the capabilities of land-based electronic-intercept stations and space satellites to capture radio, satellite, microwave, cellular, landline, internet and fiber-optic communications traffic. 
 
The Task Force would like to understand more about the capability to process these captured signals through computers that will search for communications regarding targeted addresses, words, phrases, or even individual voices. 
 
Beyond this, the group is interested in learning how those identified by such means might be subjected to further individual surveillance or investigation and how quickly and far any "networking" analysis would likely be conducted.

The Discovery Revolution - New Release from the Section of Science & Technology Law

The latest book from the Section of Science & Technology Law "The Discovery Revolution" focuses on the e-discovery amendments to the Federal Rules of Civil Procedure, which were approved by the Judicial Conference of the United States on September 20, 2005. The issues addressed by the new rules will significantly impact the way law is practiced and are discussed in detail in the book. These include such topics as the concept of electronically stored information; the new approach to pre-discovery meetings; the form of production of electronic evidence; inaccessible evidence; preservation of evidence when routine processes may destroy it; the safe harbor, and privilege waiver issues.
