Tax Opportunities and Pitfalls in Real Estate Workouts
We will explore the tax impact if debt is discharged in a sale or by agreement among the parties. We will discuss the recently enacted tax law change that allows for deferral of cancellation of debt income as well as other ways to eliminate recognition of debt discharge income (for example, exclusions for principle residence debt, bankruptcy, insolvency, purchase price adjustment, and qualified real property indebtedness). We will also address how a modification of the terms of a debt instrument can cause tax concerns even if the principal remains intact, and ways to reduce that tax exposure. Lastly, we will focus on cross border debt workouts and the added tax pressures that may put on a transaction.Speakers:
