After City of Chicago v. Morales: If Youth "Hang Out" on the
Street, Are They Breaking the Law?
The Supreme Court recently struck down Chicago's anti-gang loitering law because it
"Affords too much discretion to the police and too little notice to citizens who wish
to use the public streets." Yet cities and communities of all kinds have legitimate
needs to ensure public safety and the general welfare. How should we reconcile these needs
-- in venues such as neighborhoods, malls, and urban centers -- with the First Amendment's
guarantee of freedom of association? |
