The Juvenile Justice and Delinquency Prevention Act of 1974 established a number of
guidelines protecting juvenile offenders within the justice system. Although federal
statistics show a steady decline in juvenile crime, including violent crime, proposed
legislation loosens many of the protections and lowers the age for youth to be transferred
to adult court. Proposed legislation also provides incentives for states to enact
legislation lowering the age for children to be prosecuted in adult court and changes
states' responsibilities regarding the disproportionate confinement of minority youth.
