Tips for Preparing for Mediation

Following are some things to think about prior to mediation:

  • Define the specific issues you want to discuss.
  • Identify your needs and interests -- decide what is really important.
  • Establish your priorities.
  • Know your legal rights.
  • Explore a wide variety of possible solutions.
  • Anticipate the other person's point of view and interests.
  • Be sure your ideas are realistic, reasonable, and possible.
  • Be willing to compromise.
  • Work to maximize the joint gain, or minimize the joint loss.
  • Consider the mutual benefits of agreement.
