Philip G. Hampton, II is a partner in the Washington, D.C. office of Gardner Carton & Douglas. A member of the firm's Technology Department, Mr. Hampton's practice is concentrated in intellectual property law, with special emphasis on patent litigation and counseling and trademark prosecution, litigation and counseling, as well as intellectual property aspects of the internet and all types of intellectual property licensing. Mr. Hampton also serves as an expert witness in contested trademark matters. Prior to joining Gardner Carton & Douglas in 1998, Mr. Hampton was the Assistant Commissioner for Trademarks at the United States Patent and Trademark Office for 4 ½ years. As the Assistant Commissioner, Mr. Hampton had overall responsibility for the Trademark operations, and focused on re-engineering the trademark registration process and changing the rules and policies of the Trademark Office to make them comport more closely with the Lanham Act, case law and the needs of its customers. He also testified before Congress on intellectual property issues, represented the United States at international trademark conferences and spoke on Trademark Office practice and procedures and the intellectual property initiatives of the Clinton Administration. Mr. Hampton has lectured or written on a wide variety of intellectual property topics, including Section 337 practice, opinions of counsel vis-à-vis willful patent infringement, business method patents after State Street Bank, the first sale bar after Pfaff v. Wells , trademarks in cyberspace and gray market goods. |
