November 5  No Time Like the Present: Parenting Plans for Any and Every Age Child, Teleconference and Webcast  A panel of distinguished family law practitioners will lead a discussion on negotiating parenting plans for non-married, separated or divorced couples with children. This teleconference includes information on developing plans that are child-centered, using the age, gender and developmental stage of children to assess their needs. November 5  The EESA: How Did We Get Here and Where Are We Now?, Teleconference and Webcast  This timely teleconference will discuss the Emergency Economic Stabilization Act’s passage in the wake of one of the largest credit market crises our nation has ever seen. The program explains the economic background of our current financial crisis, key provisions of the EESA and what the Department of the Treasury is doing to implement them. November 6  Update on Rights in Technical Data and Computer Software, Teleconference and Webcast  Experts on government contract intellectual property issues will present developments in the areas of technical data rights and rights in computer software. November 6  Danger, Will Robinson: Introduction to Securitized Lending, Part Three of the Essential Issues in Commercial Real Estate Law 2008 Teleconference Series, Teleconference and Webcast  Securitized mortgage lending has drastically changed the landscape for commercial lending in the United States. Program listeners will learn more about securitized mortgage lending, including the major differences in loans that borrowers, lenders and their counsel must be aware of. November 7  The 12th Annual National Institute on Class Actions, Live Conference  This program will address new developments in class actions, as well as consumer fraud class actions and the “rigorous analysis” standard. November 12  Advanced Problems in Insurance Mediation, “Reservation of Rights” in the Defense of Third-Party Claims, Teleconference and Webcast  Nothing mystifies mediators more than the curious behavior of parties when an insurance company defends a claim under “reservation of rights.” To be effective, a mediator must understand more than the basics. He or she needs to understand each participant’s tensions, how they interact, and how to help participants work their way through to settlement, all of which will be discussed during this upcoming teleconference. November 11  The Educated Use of 529 Accounts: Opportunities, Risks, and Complexities, Teleconference and Webcast  Although 529 accounts provide a tax-advantage for clients looking to save for college and graduate school, trust and estate lawyers need to be able to advise clients on the complicated rules and potential pitfalls. November 12  High Speed Chases, Dog Bites and Electronic Control Devices: An Overview of Police Liability and Use of Force, Teleconference and Webcast  On the big screen, car chases, dog bites and electronic control devices used by police add excitement and drama, but the consequences of these actions in real life are almost never explored. Panelists on this program will address police liability issues, including when deadly force is “reasonable,” findings of excessive force, and when multiple use of an electronic control device constitutes excessive force.
