The Mississippi Supreme Court has held that trial courts should hold hearings on Daubert challenges to expert testimony: Smith v. Clement.

Effective November 1, 2007, Utah adopted a new Rule 702 which is similar – but not identical to – the Federal Rule. (E.g., under Utah law, a party or party lawyer may draft the expert report.) The new Rule 702 can be found here.
