Regulatory Scheme: South Dakota Rule of Professional Conduct 7.4 designates the ABA as the appropriate regulatory authority to accredit certifying organizations and provides for lawyers' communication of information regarding certification where the certification is awarded by an ABA accredited program. While lawyers certified by non-accredited programs may reference information regarding certification, they must include a disclaimer clearly stating the absence or denial of ABA accreditation [Rule 7.4(c)(2)].
