Regulatory Scheme: Massachusetts Rule of Professional Conduct 7.4 permits lawyers to hold themselves out as specialists and to state that they "concentrate in," "specialize in," are "certified in" or have "expertise in" a particular field of law as long as such statements are not deceptive, name the certifying entity and also include the following disclaimer: "(Name of Certifying Organization) is a private organization whose standards for certification are not regulated by the Commonwealth of Massachusetts." In addition, the rules indicate that lawyers holding themselves out as specialists are implying expertise and, as a result, should be "held to the standard of performance of specialists in (the) ... particular area."
