Regulatory Scheme: Maine's code of professional responsibility permits lawyers to make truthful statements identifying fields of specialty practice or "reporting certification or other recognition of expertise conferred by a named organization that has been approved by the Maine Board of Overseers of the Bar." [Rule 3.8(b)]. The state plan of specialization permits the Board to "approve without further investigation an organization that has been approved by the American Bar Association." [Maine Bar Rules - Rule 4(d)(24). Proposed revisions currently before the Court would allow communication of specialty certificaton only where the Maine Board of Overseers of the Bar has approved the certifying organization's program.
