Regulatory Scheme: Idaho Rule of Professional Conduct 7.4 permits lawyers to communicate information regarding certification as long as the certification is awarded by the Idaho State Bar or "an organization which has been approved by the Idaho State Bar" [Rule 7.4]. Communications must also state the name of the certifying organization. The state bar does not directly certify lawyers as specialists, but presumptively recognizes ABA accredited programs. The bar has also approved programs sponsored by the Idaho Trial Lawyers Association. There are enhanced CLE requirements for attorneys holding themselves out as specialists or certified specialists. New Rules have been proposed that permit a lawyer to state he or she is certified if the certifying organization is approved by the Idaho State Bar pursuant to Section X of the Idaho Bar Commission Rules.
