Regulatory Scheme: The Alabama Rules of Professional Conduct permit lawyers to indicate that they are certified specialists where the certifying organization has been "previously approved by the Alabama State Bar Board of Legal Specialization..." [Rule 7.4(c)]. The comment to Rule 7.4 requires that communications regarding specialty certification include the name of the certifying entity. While there is presumptive approval for ABA accredited certification programs, these programs must show proof of accreditation and pay a registration fee to the State Bar Board of Legal Specialization. ABA accredited programs sponsored by the American Board of Certification, the American Board of Professional Liability Attorneys, the National Board of Trial Advocacy and the National Elder Law Foundation are recognized in Alabama. Non-Accredited programs must apply directly to the State Bar Board of Legal Specialization and pay a registration fee. (11/04)
