The study released August 2005 by the ABA Standing Committee on Lawyers¿ Professional Liability, analyzes malpractice claims against lawyers covered by insurance carriers who participated in a survey. The report compares new data from 2000-2003 with prior studies conducted in 1996-99, 1990-95 and 1983-85. Though the period studied included upheavals in certain sections of the economy, the data does not clearly bear out an increase in transactional ¿dot.com¿ type claims or claims based on corporate scandals in the post-Sarbanes Oxley era. |

Mirroring the healthy economy of the late 1990s, malpractice claims against lawyers remained remarkably stable, according to "Profile of Legal Malpractice Claims: 1996-1999", a study released April 2001 by the American Bar Association Standing Committee on Lawyers' Professional Liability. The study analyzes malpractice claims against lawyers covered by insurance carriers who participated in a survey. The report, written by Joseph P. McMonigle of San Francisco, compares new data from 1996-1999 with prior studies conducted in 1990-95 and 1983-85. The study found that claims against lawyers appear to mirror the economy. Insurers can expect to see an increase in both the frequency and severity of claims against lawyers in the years following an economic downturn. |
