The NLRB, the EEOC, the Department of Labor, Judges, Judges, and More Judges
The NLRB has scheduled an oral argument in Philadelphia, Nov. 9, at 9:30 A.M. in the Ceremonial Courtroom, Room 643, Philadelphia City Hall, Broad and Market Streets, in Philadelphia. The case is New York New York Hotel, LLC, d/b/a New York New York Hotel and Casino, Case 28-CA-14519. The Board’s release says: “The issues presented in the case include whether Ark Las Vegas Restaurant Corporation’s employees, who are employed by Ark on the premises of the New York New York Hotel and Casino, have a statutory right to distribute handbills at various places on hotel property during the employees’ off-duty hours. The handbills were aimed at guests and customers and protested Ark’s nonunion status and wages.” Read More >>

Supreme Court will hear six employment-law related cases this term
On Tuesday, September 25, 2007, the Court grated review in four additional employment-law cases, bringing this Term’s unusually high total to six cases. The new cases and their issues are:

COMMITTEE SPOTLIGHT
Immigration Law Committee
The Immigration Law Committee was created in 1987 after the passage of the Immigration Reform and Control Act of 1986. The committee educates its members on employee and employer issues, including Form I-9 compliance, employer sanctions, discrimination and other employment related matters as reflected in enforcement by the Department of Homeland Security, Office of Special Counsel, and private parties both in the administrative and judicial arenas.

Choppy Waters for the DHS’ New Rule on Safe-Harbor Procedures for Employers Who Receive a No-Match Letter
The Immigration Reform and Control Act of 1986 (“IRCA”) requires that every employer in the U.S. verify the identity and work authorization status of its employees by completing the I-9 Employment Verification Form for each employee. Failure to comply with IRCA’s I-9 rules can result in significant fines, loss of government contracts and, where the failure is deemed to equate to the employer’s “constructive knowledge” that it employs workers which are not authorized to work in the United States, criminal sanctions.

ETHICS CORNER
Ethical Considerations in Reviewing and Using Metadata in Electronic Documents
The District of Columbia Bar is the most recent authority to consider whether a lawyer who receives an electronic document from an adversary is prohibited from reviewing any metadata contained in the document. In Ethics Opinion No. 341 (September 2007), the DC Bar concluded that when a receiving lawyer has actual knowledge that an adversary inadvertently provided metadata in an electronic document, the lawyer should not review the metadata without first consulting with the sender and abiding by the sender’s instructions...
