Track of the Month- Litigation

I’ll see you in Court is the comprehensive, cutting-edge litigation program planned for the ABA Section of Labor and Employment Law Annaul CLE Conference. Starting with case selection and a demand letter, it proceeds through discovery and trial to the appeal of a punitive damages award. The program will demonstrate sophisticated pre-trial and trial strategies in presentations designed to captivate the senior trial lawyer, while enabling the novice litigator to absorb years of experience and learning in just three days.

Rounds One through Four of the program review key issues in the pre-trial stage of litigation. Plaintiff, union, and management lawyers will discuss case selection considerations, helpful demand letter and response strategies, effective dispositive motion tactics, and pre-trial preparation matters including motions in limine, jury instructions, witness preparation, and demonstrative exhibit considerations. Seminar participants will learn the value and risks of conventional tactics and will be exposed to innovative approaches and styles.

Round Five presents a dynamic trial of a sexual harassment and related claims brought against the employer and the union. The seminar attendee will learn tips on effective voir dire; observe expertly crafted opening statements; gain insights for presenting the plaintiff’s and the defendants’ cases; and consider the different styles of experienced trial lawyers demonstrating the art of closing argument. The direct and cross examinations of the plaintiff, the union steward, the alleged harasser and key management personnel, and forensic psychiatrists will reveal what practitioners can do to improve their presentations and enhance their impact on the jury. Presiding over the trial will be one of the nation’s top trial judges who will provide tips from the bench on how lawyers can win and lose employment trials.

Round Six offers the seminar attendee a remarkable learning tool − the chance to do something every trial lawyer longs to do in real trials – eavesdrop on jury deliberations and learn from noted trial consultant, Dan Gallipeau, about what moved the jury to its verdict.

The Litigation Track concludes with Round Seven in which a panel of three appellate judges will hear appellate arguments and discuss written and oral advocacy styles that effectively promote an advocate’s position and influence appellate court judges.
