Fair and Impartial Courts - Caperton v. Massey

On March 3, the United States Supreme Court heard oral arguments in Caperton v. Massey.  The nine justices engaged in a spirited exchange with the petitioner's attorney, Ted Olson, and the respondent's attorney, Andrew Frey.  The Justice Center's Standing Committee on Judicial Independence ("SCJI") was instrumental in filing the ABA's amicus brief on behalf of the petitioner in Caperton v. Massey.  The facts surrounding this case spawned John Grisham’s “The Appeal.”

 

Doreen D. Dodson, immediate past Chair of SCJI, spoke at the Section of Litigation 2009 Winter Leadership meeting in Scottsdale, AZ on January 9, along with retired Justice Sandra Day O’Connor and ABA President Tommy Wells.  Dodson spoke about the progress of the Judicial Disqualification Project and Caperton v. Massey. 

On January 26, former Supreme Court Justice Sandra Day O’Connor quoted the ABA amicus brief in Caperton v. Massey during her luncheon address to the Conference of Chief Justices at their Midyear Meeting in Scottsdale, AZ.  She quoted from the ABA brief as she addressed the importance of judicial independence.

ABA President Tommy Wells Marks One-Year Anniversary of Immigration Justice Project

The month of February closed ABA President Tommy Wells's visit to San Diego on the one-year anniversary of the Immigration Justice Project (“IJP”), an Enterprise Fund project which was inspired by Judge Margaret M. McKeown, Chair of Standing Committee on Federal Judicial Improvements ("SCFJI").  IJP is housed at the law firm of DLA Piper in downtown San Diego.  Mr. Wells's visit kicked off on February 26 at the Otay Mesa detention facility where he witnessed firsthand IJP staff giving legal rights orientations to detainees.  Following, Mr. Wells and staff met with two former detained immigrants who shared their very moving experiences with IJP.  On February 27, the San Diego chapter of the Federal Bar Association and the San Diego County Bar Association presented a panel on IJP at the United States District Court in San Diego.  Mr. Wells, Judge McKeown and Immigration Court Judge Rico J. Bartolomei were among those appearing on the panel.  In addition, Mr. Wells met with a number of media outlets during his visit.

The Judicial Division Standing Committee on Minorities in the Judiciary has released the Fourth Edition of the Directory of Minority Judges in the United States. The only publication of its kind, the Directory serves as an excellent resource for faculty and students in colleges and universities, and others interested in a diverse judiciary. Included in the Directory is an aggregate listing of over 4,000 racial and ethnic minority judges and judicial officers.

Judicial Disqualification Project Discussed at Conference of Chief Justices Midyear Meeting

On January 25, William K. Weisenberg, Standing Committee on Judicial Independence Chair; David J. Pasternak, SCJI member; and Tina Vagenas, ABA staff, attended the Conference of Chief Justices Professionalism and Competence of the Bar Committee meeting in Scottsdale, AZ to discuss the Judicial Disqualification Project. 

SCJI Member Participates in the Charleston School of Law Symposium

Standing Committee on Judicial Independence member, Alan D. Rudlin, was a panelist at the Charleston School of Law Symposium in Charleston, South Carolina on January 16th.  It was titled: “State Constitutional Reform in the New South.”  Mr. Rudlin presented on judicial selection, judicial diversity, and related issues.

NHTSA Adds Three Judicial Outreach Liaisons

The National Highway Transportation Safety Administration has funded the addition of three Judicial Outreach Liaisons.  Those selected after review of applications by the NCSCJ and NHTSA are Judge Kenton G. Askren (NHTSA Region 7), Judge G Michael Witte (NHTSA Region 5), and Judge Frederic B. Rodgers (NHTSA Region 8).  They join Judge Karl B. Grube (NHTSA Region 4), Judge Lynda Howell (NHTSA Region 9) and Judge Mike Padden (NHTSA Region 10).  Also joining the program are two new Judicial Fellows.  Judge Brian MacKenzie is the NCSCJ Fellow, and Judge John Priester is the NCALJ Fellow.
