Under Pressure:  How Do we Keep the Courts Fair and Impartial?Are you familiar with the term “separation of powers?” Do you know what it means? Would you like to know more about the purpose of the judiciary and where it fits into the three branches of government?  This issue booklet will guide you through a discussion regarding the role of the judiciary, its separate and independent powers and areas of responsibility. Three possible approaches with different perspectives and remedies of how the courts can be fair and impartial are presented.  Each approach includes some explanation of why proponents of that view believe it is the best way to resolve the issue, as well as some of the concerns others have with the approach.  Participants will need to consider each approach and share perspectives while evaluating the pros, cons and consequences.  The goal is to reach an understanding of the problems and to agree upon a solution.

This booklet is intended to help promote deliberative dialogue about the judiciary.  It is not, by any means, the only way to talk about the issue, but it provides enough structure to focus on the judiciary and the courts and to begin talking about them productively.  By participating in this discussion, you are gaining a better understanding of our government. Comments gathered from this discussion by the organizer of this forum, may be shared with state and local bar associations, courts and other organizations that are working to educate the public on the judiciary and the justice system.
