A growing number of mutual funds have been
named in investigations for illegal or improper trading practices.
Even as formal federal and state charges are filed, employers
and other ERISA plan fiduciaries remain uncertain as to the
actions that they should be taking in response to the mutual
fund scandals. The panelists will review the ramifications
of these investigations and the mutual fund regulatory agenda
of the Securities and Exchange Commission. In an interactive
discussion, practitioners will consider responsive alternatives
available to ERISA fiduciaries.
Topics Include:
- Mutual fund trading practices at issue
- State-imposed mutual fund protection principles
- Impact on retirement plans of proposed 4:00 close
and 2% redemption fee
- Effect of settlement by a mutual fund
|
- SEC proposed rules
- Fiduciary issues regarding:
- Market timing
- Participant trading restrictions
- ERISA Section 404(c) relief
