A number of new cases have been handed down
on cash balance issues involving IBM, Xerox, CBS, & BankBoston.
Damages may be immense, as the plans at issue hold many billions
of dollars of assets. The issues are juicy & intractable:
age discrimination, whip-saw interest rates, and wear-away.
The case law continues to evolve as more courts weigh in.
