The Supreme Court's decision this term in
Great-West v. Knudson left ERISA lawyers everywhere
scratching their heads. Although ostensibly involving only
a plan's subrogation claim against a third-party recovery,
the decision reopened the question of just what remedies are
available under ERISA. Our program is in two parts: (a) How
Great-West affects subrogation claims specifically;
and (b) how Great-West affects issues of ERISA remedies
generally. Here's what you will learn
