The ABA Joint Committee on Employee Benefits (JCEB) coordinates the activities of the employee benefits committees of six sections. Those activities include CLE programs and annual meetings with federal agency officials that are reported as a series of questions and answers from each agency.

Each year, the JCEB meets with officials of federal agencies in Washington, DC, to discuss issues of interest to employee benefits practitioners. Based on these informal discussions between private sector representatives of the JCEB and agency officials, question and answer transcripts are then drafted. Since the Department of Labor issued final regulations on “qualified default investment alternatives” (“QDIAs”) last fall, a number of legal and practical questions have been raised as employers and plan fiduciaries seek to apply those rules. The DOL responded to some of those questions by issuing additional guidance in the form of Field Assistance Bulletin 2008-03 and technical amendments to the final regulations. Many plans are choosing so-called “life cycle” or “target date” funds but most of them have a limited track record and some have changed their asset allocation formulas, creating confusion about how to compare the available default options and choose the right one for your plan.
