At the ABA 2005 Midyear Meeting, the ABA House of Delegates will consider a proposed resolution developed by the Section opposing governmental actions and policies that interfere with patients' abilities to receive from their healthcare providers (a) all of the relevant and medically accurate information necessary for fully informed healthcare decision-making; and (b) information with respect to their access to medically appropriate care. The proposed resolution is co-sponsored by the ABA Health Law Section.
Two Section-sponsored programs are among the Section's events scheduled for the Midyear Meeting in Salt Lake City, Utah. On Friday, Feb. 11, a program entitled, "Slavery and Post-Slavery Redress: Do We Need a Study?" is being held at the Prime Hotel and Suites. Panelists will examine the purpose and parameters of a study addressing post-slavery redress and will discuss slavery and post-slavery redress issues generally. On Saturday, Feb. 12, the Section will present, "The United States'
Responsibility to Indian Trust Beneficiaries: An Examination of the Historic
Cobell v. Norton Case" at the Prime Hotel and Suites. Panelists
will discuss Cobell v. Norton, a case in which the U.S. Federal
District Court ruled that all sales and transfers of Indian-owned land
by the Department of the Interior (DOI) must include a detailed court-approved
notification of the landowner's rights as trust beneficiaries and class
members. The Court's ruling marks the first time in history that such
notification has been required of DOI before the agency sells Indian land.
