FROM THE CHAIR
Dear Members:
It is always invigorating to come together with Section members, and last month's ABA 2007 Midyear Meeting in sunny Miami, Florida, did not disappoint. We had several meetings, the largest and most significant of which were with the Administration Committee and the Council. Highlights of those meetings follow.
Also in February, we were able to gather with hundreds of international law students and young lawyers for a Pathways to Employment in International Law program at the Inter-American Development Bank in Washington, D.C. Thanks go to Vice Chair Aaron Schildhaus for leading the effort to organize the program, which also included the invaluable contributions of YIN Co-Chairs Magda Theodate and Demetrios Eleftheriou and Law Student and Young Lawyer Outreach Committee Co-Chairs Ian Meyeroff and Jennifer Green. Our Pathways programs are extremely popular and very valuable. If you would like to host a Pathways event for law students and young lawyers in your area, please contact Membership Director Angela Benson at bensona@staff.abanet.org for a Pathways kit.
This Saturday, March 3, ABA and Section leadership will embark on our first ILEX trip to West Africa. We will visit Ghana, Liberia and Sierra Leone, where we plan to join with the citizens of Ghana in celebrating their country's 50th Anniversary of Independence. I look forward to writing to you next month and reporting on the details of our journey
Deborah Enix-Ross, Section Chair
REPORT FROM ABA 2007 MIDYEAR MEETING
- As part of an extensive Administration Committee report on the Section’s periodicals and books, Publications Chair Mark Wojcik announced the establishment of a new ten-member Book Publications Board.
- Membership Chair Gabrielle Buckley delivered the good news that Section membership has increased in all categories; we now have nearly 15,250 members! Gabrielle also confirmed that the Section has reached a cooperative agreement with the International Law Students Association that promises to raise the Section’s profile and recruit new members from among law students worldwide.
- The Administration Committee approved the creation of a Diversity Officer position. The Diversity Officer will be responsible for the development and effective implementation of a diversity plan for the Section to increase the numbers in the Section and particularly, in leadership roles and positions, of lawyers of color, women lawyers, younger lawyers, lawyers with disabilities, lawyers with non-traditional sexual orientations and gender identifications, and lawyers from around the world and in different international practice areas.
- The 2007 ABA Day at the U.N. will take place in New York on April 17. For additional information, please contact Rule of Law Associate Christina Heid at heidc@staff.abanet.org.
- ABA Day on the Hill will take place on April 18, 2007. This is an annual tradition in which ABA leaders meet with members of the U.S. Congress and Senate on Capitol Hill to discuss the most pressing issues for the legal profession. Thanks go to Council Members John Magnus and Eddie Dick, who are drafting a summary for participants on the topics of treaty ratification and the international operations side of the U.S. budget.
- Section Secretary Glenn Hendrix reported that the Section is developing a proposal for the ABA’s new Enterprise Fund, which will award grants to bring together ABA entities in innovative and sustainable joint projects.
- Financial Officer Salli Swartz reported that the 2006–2007 Section budget is coming in above projections and that the Finance Committee is developing a new investment policy for Section funds. Chair-Elect Jeff Golden reported that the Section is in ongoing negotiations with LexisNexis to renew our sponsorship agreement.
At the ABA Midyear Meeting, the House of Delegates approved the Section's recommendation relating to the foreign investment review process commonly known as "Exon-Florio." The recommendation adopts clear standards that would apply to any legislation addressing national security review of foreign investment to assure that the limited purpose of Exon-Florio is maintained. Many thanks go to the members of the Exon-Florio Working Group: Milos Barutciski, Harry Clark, Nelson G. Dong, J. Scott Maberry, Conor Maguire, Dixon Miller, Richard Romney, Suzanne E. Spaulding, Jim Walther, and — ex officio — John Magnus and Tim Brightbill.
We want to hear from you on policy issues you think the Section should be developing. Please contact relevant committee officers if you have an issue of broad significance. Section committees, their chairs and e-mail addresses can be found at www.abanet.org/intlaw/committees.

International Litigation Strategies and Practice
International Litigation Strategies and Practice focuses on the strategy and practice of international litigation. Part One discusses the essentials, including finding the right lawyer for the job overseas, communicating with foreign clients and lawyers, understanding the differences and similarities between civil law and common law systems, protecting yourself from falling into ethics traps, and introducing the U.S. legal system to your foreign clients.
Part Two addresses the strategic decisions and practice tools necessary to successfully initiate, defend, and conclude a transnational case. Issues covered include international mediation, selection of forum, provisional measures, defense strategies, anti-suit injunctions, obtaining evidence abroad, and enforcing foreign judgments in the U.S.
Part Three covers special problems and tribunals. This material introduces you to specialized international fora and problems so that you can assess whether they merit further evaluation.
Twenty-three seasoned contributors offer their firsthand insights to make this volume an essential resource for practitioners involved in any international litigation.
For the domestic litigator new to international litigation, this book will level the playing field when faced with an international litigator as opposing counsel. For experienced international litigators, this volume serves both as a source of new ideas and as an excellent check to ensure that important strategies have been considered. In-house counsel will find International Litigation Strategies and Practice to be valuable in evaluating the quality of the strategy of their litigation counsel and in ensuring the use of the most cost-effective approaches.
