Crouching Tiger, Hidden Dragons: Ireland’s Success Story to date and the Challenge that Lies Ahead

Ireland's economic success story has been widely reported in international circles. While Ireland remains an attractive location for foreign direct investment, the competition is stiffening and with it the challenge to secure Ireland's future as a location for such investment, in particular from the US. A panel of distinguished speakers will discuss this challenge in the context of attempts to foster an environment where superior performance can be enjoyed in the longer term. The panel will focus on economic, tax and fiscal developments, policies and trends at domestic Irish and EU level, against the wider backdrop of what US investors in particular are looking to in Ireland and elsewhere when considering and assessing potential foreign direct investment opportunities. In a time where innovation and diversification are key, the panel will consider what lies ahead for Ireland in its goal of ensuring that it continues to be in a position to offer a distinctive product to its foreign investors.

Cartel Criminalization in Ireland and Europe

The success of the American cartel enforcement experience is often attributed to the criminalization of the offence. But is the American cartel experience transplantable to Ireland and Europe? Recent developments in Irish competition law enforcement, in particular, last year’s successful criminal cartel trial – reputedly, the first in the EU – may provide an answer. Like the U.S., Ireland today treats price-fixing as an indictable offence – conviction for which carries a maximum five-year term of imprisonment. But do differing national traditions (in particular as regards leniency, plea-bargaining, rules of evidence and other complexities) hamper enforcement here and in other Member States? Has EU modernization limited the ability of national agencies to apply criminal powers to cartels?

Financial Services: Future Directions of Ireland's Capital Markets and Financial Services Regulation

Northern Ireland: The Historical Conflict Resolution and the application of the Rule of Law

On 8 May 2007, following all-party commitment to the full operation of stable power-sharing government in Northern Ireland and to full support for policing and the criminal justice institutions, the institutions of the Good Friday Agreement were restored. As Taoiseach Bertie Ahern put it when addressing the joint Houses of Parliament Westminster, “This is not an end of history. But it is a new beginning.” This unique programme will explore the conflict resolution process, the on-going work in consolidating peace, the lessons that might be learnt for conflicts elsewhere, and the importance of recognition that the Rule of Law should play a fundamental and ongoing element in any resolution of the conflict.
