Behavioral Advertising
Roundtable

You are invited to join your peers and other experts for an in-depth collaborative discussion organized by the ABA-IPL Special Committee on Promotions and Marketing Law, where we will examine the legal issues surrounding behavioral advertising.

Behavioral advertising – tracking consumer’s habits and developing targeted advertising content based on the results of that tracking – has been subject to increased scrutiny in recent years, as the technology available to track consumers has gotten more sophisticated, and as consumer advocacy groups and government agencies have become more aware of the practice. In the online world, a company can obtain information about a consumer’s searching habits, and based on those searches, offer directed advertising. Many companies are sharing searching habits across websites. The FTC recently held a town hall on this practice, and as a result of that meeting, created a list of “proposed principles” for industry self-regulation. During this session, we will examine those principles, including whether they will be enough, or perhaps too much. We will also look at the self-regulatory scheme, and the overlap in enforcement that may come from the FTC and state attorneys general on this issue.
