As employers seek ways to lower healthcare costs and encourage healthier behaviors among their employees, many are implementing wellness programs that provide rewards (or penalties) to encourage healthy behaviors. These programs must comply with HIPAA's nondiscrimination rules, and the EEOC has recently indicated that it will be scrutinizing these programs for compliance with the Americans with Disabilities Act as well.
