Program Overview:
The U. S. Department of Justice has issued new guidelines regarding corporate prosecutions including what constitutes cooperation in the context of negotiations regarding charging decisions. The newly-released “McNulty Memorandum” addresses waiver of attorney-client privilege and work product protections and payment of employees’ legal fees. The new guidelines replace the so-called Thompson Memorandum (dated January 20, 2003) and the McCallum Memorandum (dated October 25, 2005). The program will discuss the McNulty Memorandum, whether it is a departure from past practices of the U.S. Department of Justice, and how it will affect your enforcement practice. Views provided from the U.S. Department of Justice and private practitioners.
