Program Overview:
With a May 14, 2007 Federal Register Notice, “Enhancing Environmental Outcomes from Audit Policy Disclosures through Tailored Incentives for New Owners,” (72 Fed. Reg. 27,116), EPA has launched a 60-day public comment process, including two public meetings, to explore ways to increase environmental outcomes through implementation of the Agency’s leading compliance incentive settlement policy, the “Audit Policy,” and to encourage the Policy’s use by “new owners” after M&A transactions. EPA is considering offering tailored incentives to encourage new owners to audit their newly acquired facilities and self-disclose to the Agency. Exploring this idea is part of an effort to increase disclosure and settlement of violations that, once corrected, will yield significant pollutant reductions and environmental benefits. Questions on which EPA seeks comment include:

  • 1) Whether tailored incentives are appropriate and necessary to maximize environmental outcomes, and whether the Agency should test this idea through a pilot program;
  • 2) Who is a “new owner” for purposes of taking advantage of such tailored incentives;
  • 3) Which incentives should be considered (with specific questions on various methods for calculating and assessing penalties to capture economic benefit); and
  • 4) How to measure the success of a pilot program.

On the conference call, an EPA representative will describe the notice and the issues raised, and perspectives on the audit policy will be provided by interested industry and NGO parties.
