Program Overview:
Hear the attorneys for the three cases that had certiorari petitions before the Supreme Court discuss the Court’s response to the petitions, what its acceptance of the petition in the Atlantic Research case may mean for the future of CERCLA contribution actions, and the key outstanding issues in the post-Aviall world. Teleconference will include a discussion of the potential availability of CERCLA § 107 to bring contribution actions that the Aviall decision barred under § 113.

Educational Objectives:

  • Understand the post-Aviall issues accepted and rejected by the Supreme Court for review.
  • Hear from the attorneys in the cases that had certiorari petitions.
