Program Overview:
Prosecution of shipping companies and their crew for violations of United States law related to vessel pollution has been on-going for over a decade. In the last two years alone over 60 companies have been charged with criminal violations related to pollution incidents at sea. While companies have been prosecuted for violations that occur in port, the pollution itself most often occurs outside of U.S. waters. The teleconference will examine the U.S. jurisdiction to prosecute these crimes. It will also provide guidance to lawyers representing companies on the options for responding to a Coast Guard boarding of a company vessel and subsequent criminal investigation. The teleconference will examine a provision in U.S. law that allows for the court to award a person who provides information leading to conviction up to half of a criminal fine, as well as new rules regarding air emissions from ships. Finally, the program will explore just how widespread the illegal discharge practices are and what industry can do to achieve greater compliance.
Who Should Attend:
The teleconference is essential for anyone working on maritime or shipping matters involving ocean going vessels. The discussion will provide guidance regarding what type of conduct is likely to result in criminal prosecution and options regarding how to approach the government when a client becomes a suspect in an environmental crime investigation or prosecution.
