Program Overview:
This quick teleconference will set the foundation for an ongoing discussion regarding the applicability of the Clean Air Act (CAA) to greenhouse gas (GHG) emissions from stationary sources and the programmatic implications of potential regulation. The speakers include respected authorities, including environmental advocacy, industry and current EPA counsel as well as former EPA General Counsel, who will provide their perspective on how the CAA might apply to stationary source emissions of GHG. The panel will review EPA’s response to the Supreme Court decision in Massachusetts v. EPA, and consider the ongoing appeal of the Deseret Power PSD permit before the EPA Environmental Appeals Board. Finally, this discussion will review EPA’s recent Advanced Notice of Proposed Rulemaking in response to Massachusetts v. EPA. Specifically, our speakers will discuss the potential scope of GHG regulation under the CAA’s New Source Review and New Source Performance Standard provisions, as well as other possible CAA mechanisms that could be utilized to regulate stationary source emissions of GHGs.

Educational Objectives:

  • Provide context for ongoing proceedings regarding the application of the CAA to stationary source emissions of GHG
  • Provide a clear summary of the statutory foundation and legal arguments underlying the positions of environmental advocacy groups, industry and policy makers regarding the scope and mechanics of CAA applicability to stationary source emissions of GHG
  • To give the audience sufficient basis to anticipate future GHG regulation impacting stationary sources
