Program Overview:
This teleconference will examine the legal aspects of carbon capture and storage at the international, national, regional and state levels. The speakers will first provide a broad overview of the technical issues associated with capturing and storing carbon dioxide. The speakers will next provide an international perspective on carbon capture and storage by reviewing regulatory and legal issues affecting storage development including international marine and climate change treaties and conventions. At the national level, speakers will provide an overview of ownership issues associated with geologic storage reservoirs. The speakers will discuss how to define injected carbon dioxide, determine ownership of injected carbon dioxide and review the established basis for liability and liability frameworks for carbon dioxide storage. The speakers will also discuss how to manage liability long-term including the role of federal and state government, insurance, bonding and the use of immunity caps. The speakers will conclude by examining recent legislative and regulatory developments at the national, regional, and state levels including: the expected rulemaking by the United States Environmental Protection Agency under the Underground Injection Control program of the Safe Drinking Water Act; introduced federal legislation; and individual state legislative and regulatory developments.
Educational Objectives:
- Provide listeners with a general understanding of the technical issues and historical uses associated with carbon capture and storage.
- Examine the legal issues associated with carbon capture and storage at the international and national levels including ownership issues of the underlying formations and the injected carbon dioxide, the basis for liability and established liability frameworks.
- Examine how to manage liability long-term including the role of federal and state government, insurance, bonding, and the use of immunity caps.
- Review carbon capture and storage legislative and regulatory developments at the federal, regional, and state levels.
