Program Overview:
This program will provide a basic overview of the potential environmental liabilities and business risks associated with the acquisition and development of commercial and industrial property, as well as tools for managing them.

The U.S. EPA considers "brownfields" as abandoned, idled, or under-used industrial and commercial facilities where expansion or redevelopment is complicated by real or perceived environmental contamination. Listeners will learn the "need-to-know" aspects of dealing with brownfields and proven strategies to lower and shift risk.

This presentation will serve as the lead in a number of forthcoming Environmental Transactions and Brownfields Committee sponsored quick teleconferences to understand and manage the brownfield process. Future sessions are expected to include:

  • Environmental Due Diligence for Transactions Involving Brownfields Sites
  • Environmental Insurance — What's New; What Works
  • Allocating Liability/Negotiating Strategies

Educational Objectives:

  • Define “brownfields’ and provide a historical context
  • Identify federal and state statute-based liabilities and common law liabilities of brownfields
  • Outline federal and state liability protections and risk transfer mechanisms for brownfields
  • Introduce transactional considerations and development incentives for brownfields
