The Section is pleased to introduce a new monthly teleconference series focusing on key issues, concepts and approaches that arise in various types of environmental litigation (civil, criminal, administrative, and private party). These programs will provide participants with the ability to understand and develop techniques from seasoned trial lawyers which are essential to preparing and trying environmental cases. This is a unique opportunity for those interested in learning basic litigation concepts underlying environmental cases, as well as an opportunity for more experienced practitioners to refresh and update their knowledge. PowerPoint slides will be presented to attendees simultaneously over the internet through a slide webcast presentation. Logistics associated with teleconference and slide webcast will be provided with your confirmation of registration. Each program will feature a live Q&A session.
Session 3: A Practitioner’s Guide to Citizen Suit Litigation

Program Description:
This teleconference will provide an overview of and a practitioner’s guide to the nuts and bolts issues of citizen suit litigation under the various federal environmental statutes: CERCLA, the Clean Air Act, the Clean Water Act, RCRA and the Safe Drinking Water Act. Get perspectives from practitioners representing both plaintiff and defendant interests in cases involving both regulatory enforcement and imminent endangerment causes of action. Hear practitioners provide insights and practice tips on topics such as standing and abstention, jurisdictional notice requirements, expert qualifications needed to bring or defend “imminent and substantial endangerment” cases for health and for environmental risks, future risk as a cause of action, remedies, and fee petitions for recovery of litigation costs.
