This edition features mold, which some say is today's "asbestos." It's not that mold is a new substance, but rather that improved air-tightness within buildings and an increase in awareness have made it a "new" issue for environmental practitioners. Recent large court awards and a surge in mold-related claims have increased the financial stakes and the interest of many. The articles in this newsletter address the science of mold, contracts, insurance, litigation, proactive measures and transactions.
One of the major uncertainties is the absence of legal, uniform standards, just as was the case with asbestos. To obtain some guidelines, practitioners can access EPA's Website (www.epa.gov/iaq/pubs/molds/index.html) and New York City's Website (www.ci.nyc.ny.us or www.nyc.gov/html/doh/html/epi/moldrpt1.html). As EPA's guidelines state, how "you know when you have finished remediation/cleanup, ... there is no easy answer."
