Environmental Transactions and Brownfields Committee - Newsletter Archive

The District of Columbia Council enacted brownfields legislation in late 2000; that legislation recently became law following mandatory Congressional Review. The statute created a Voluntary Cleanup Program within the District's Environmental Health Administration. Like many other state brownfields laws, the District's establishes a mechanism for owners or prospective purchasers of contaminated properties to submit a cleanup action plan to the local regulatory agency. If the agency approves the plan and it is implemented, the District will issue a "Certificate of Completion" releasing the party from liability. The law also establishes various financial incentives for parties involved in brownfields transactions. The District currently is in the process of drafting regulations for the program, which will include cleanup standards.
