Message from the Chair
Welcome to members and prospective members of the Restructuring of the Electric Industry Committee. The Committee was formed in 2003 and reflects the dramatic industry, regulatory and structural changes taking place in the electric industry. The Committee seeks to address electric industry restructuring issues in a variety ways, including participating in annual meetings, teleconferences, and publications like the Energy Committees Newsletter, Trends, and The Year In Review. We welcome new members and all interested in restructuring issues.
About the Committee
The Committee seeks to monitor substantive and practice issues within its purview and respond to member needs by: (1) jointly sponsoring a program or programs at the ABA Annual Meeting; (2) sponsoring programs at the Section's Annual Fall Meeting; (3) contributing to the Section's Year in Review publication; (4) publishing one or more Committee Newsletters; and (5) developing Rapid Response programs to address breaking developments. The Committee leadership strongly encourages member participation in the various activities of the Committee -- there are many opportunities for those with interest to get involved.
The Committee leadership has recently identified the following emerging substantive and practice issue topics within its purview that it intends to monitor and report on at appropriate times:
- Electric Industry Restructuring Legislation, with emphasis on the national energy policy bill being debated in the 108th Congress and any major state electric industry restructuring legislation (including any federal or state legislation relating to the August 2003 electricity blackout in the Northeast and Upper Midwest); and
- Electric Industry Restructuring Regulation, with emphasis on the Federal Energy Regulatory Commission's (FERC) standard market design rulemaking, the FERC proposal issued in July 2003 to establish market behavior standards for holders of market-based rate authority, ongoing FERC dockets relating to development of Regional Transmission Organizations and establishment of Independent Transmission Companies, FERC implementation rulemakings resulting from enactment of any federal energy policy legislation, and rulemakings and orders related to issues arising from the August 2003 electricity blackout. The Committee will also focus on states that are in the process of implementing major industry restructuring legislation (e.g., Texas) and states that are dealing with the aftermath of problematic experiments with restructuring (e.g. California).
