Correction to the Previously Published Model Standards of Conduct
As a service to our readers, Dispute Resolution Magazine printed the full text of the revised Model Standards of Conduct for Mediators in the Winter 2006 edition. Unfortunately, the printed version did not include a late change to Section VIII(B)(2) made by the ABA House of Delegates.
The published version stated: "While a mediator may accept unequal fee payments from the parties, a mediator should not use fee arrangements that adversely impact the mediators ability to conduct a mediation in an impartial manner."
The final version approved by the House of Delegates, September 2005 now reads: "While a mediator may accept unequal fee payments from the parties, a mediator should not allow such a fee arrangement to adversely impact the mediator's ability to conduct a mediation in an impartial manner."
