Mission Statement

The Elder Law, Disability Planning and Bioethics Group consists of three committees that focus on legal concerns of the elderly and persons with disabilities, along with legal and ethical issues related to new medical technology.

WELCOME TO THE GROUP ELDER LAW AND DISABILITY PLANNING HOME PAGE

The three committees focus on elder law and disability planning issues of most interest to estate planning and elder law attorneys. The four committees work closely together as a group but are divided for convenience into four subject areas. Surrogate Decision Making has developed an innovative website on durable powers of attorneys and has been active in numerous conferences and legislative efforts concerning guardianship law and practice. Long-Term Care, Medicaid and Special Needs Trusts has focused primarily on issues related to the drafting and administration of special needs trusts. Lastly, Bioethics deals with estate planning issues raised by new biotechnologies such as cloning.

Committee chairs and committee members are frequently asked to advise the Section leadership on policy positions to be adopted by the ABA House of Delegates. The Committees have been active in presenting CLE programs and in authoring articles for Probate & Property and the Real Property, Trust and Estate Journal. Interested committee members have numerous opportunities to participate in projects and to present their own ideas for projects.
