Pro Bono Committee

ABA Section of Real Property, Trust & Estate Law

Pro Bono Committee

Mission

This committee's objective is to serve the real property needs of low-income citizens and to educate the general public on common real property law issues. The committee initiates and facilitates pro bono activities through which Section members may contribute to their local communities. Within the context of local, regional and national real estate related projects sponsored by community service organizations, the committee provides and coordinates the services of attorneys. In addition to valuable contributions to their local communities, attorneys' participation in such projects fosters respect and positive community recognition for solo practices, firms and the legal profession as a whole. The committee's initial project involved working with Habitat for Humanity International to provide and coordinate volunteer attorneys to serve the legal needs of the organization at local (affiliate) and national levels.

ABA Dues Waiver May Be Available Based on Pro Bono Work

The ABA Board of Governors has approved a plan it hopes will further encourage lawyers to contribute to their community by making retired and inactive members who have provided 500 hours of pro bono service in the prior year eligible for a waiver of their ABA membership dues. Read more:

Volunteer to Help Habitat for Humanity

Project to Provide Pro Bono Legal , Education and Board/Committee Services to Habitat for Humanity

The Pro Bono Committee's project involves working with Habitat for Humanity to provide and coordinate volunteer attorneys to serve the organization at local (affiliate) levels to address both local and national issues. Habitat for Humanity is a non-profit house building program open to all people in need of shelter. The program works in partnership with people in need to build and renovate simple, affordable housing. The houses are sold to those in need at no profit and with interest-free mortgages. Habitat for Humanity has long been recognized for its effectiveness by other nonprofit organizations, professional associates and governmental entities.

Throughout the country, Habitat for Humanity is in need of legal assistance in various capacities:

Assist local affiliates with the purchase of land, title clearance, conveyance documents and closings

Participate on local affiliate committees or boards of directors

Provide educational programs or materials for the lenders of local affiliates regarding real estate issues

Contribute to the organization's nationwide standardization of mortgage documents and the review of the proposed documents in consideration of state laws

Assist affiliates with foreclosure and bankruptcy issues

Assist affiliates with employment law & corporate governance issues

The Pro Bono Committee coordinates, on a nationwide basis, the services of volunteer attorneys to provide the above pro bono services to as many affiliates of Habitat for Humanity as possible. If you volunteer to provide land acquisition/title clearance services, contribute to educational programs or participate on a local affiliate committee or board of directors, your contact information will be forwarded to the HFH General Counsel's office in Georgia, which will establish the link between you and the local HFH affiliate board. If you volunteer to work on nationwide standardization of mortgage forms, your contribution to the project will be coordinated directly by the General Counsel's office.

The Pro Bono Committee list serve (Internet e-mail and discussion group) may be used by Pro Bono Committee members (project volunteers) serving HFH. As you become familiar with the real estate issues of local affiliates and would like to consult other HFH attorneys, you may use the list serve to request assistance or share information.

I hope that you will take this opportunity to help, in a small but important way, to serve the development of the real property of your local community while demonstrating the community interest of our legal profession and join the approximately 200 Section members who have already volunteered to work on this project.

Committee CLE Programs Presented

"Foreclosure Rescue Scams and Beyond - The New "Refinance" April 27, 2007 In the traditional foreclosure rescue scams, "rescuers" take titles to homes undergoing foreclosure, promising to stop the impending foreclosures while assuring homeowners that they still own their homes. The "New Refinance" involves a more aggressive group of equity thieves who strip the equity in victims' homes before there is any sign of foreclosure. The panel will discuss how to recognize these scams, their disproportionate effect on the disabled and elderly, and statutory, litigation and educational strategies to stop them. Presenters include Pro Bono Committee members Catherine Anne Seal, Kirtland & Seal, Colorado Springs, CO and Robert J. Strupp, Community Law Center, Baltimore, MD together with James Sugarman, Supervisory Attorney, AARP's Financial Abuse Unit The following are links to articles regarding a few of Mr. Sugarman's cases and his experience dealing with the increasing mortgage/foreclosure rescue scams. http://www.fortwayne.com/mld/journalgazette/business/16513426.htm http://www.wjfa.net/fs/bilaal.html http://www.washingtonpost.com/wp-dyn/articles/A32209-2004Jul6.html
