Uniform Commercial Code/Commercial Finance: Joint Task Force on Filing Office Operations and Search Logic

Who We Are

The Task Force on Filing Office Operations and Search Logic has been formed to address issues relating to filing and searching under Article 9 of the Uniform Commercial Code. The Taskforce will cooperate closely with International Association of Commercial Administrators (IACA) to (i) collect and disseminate information on how filing systems operate, with particular attention to differences among individual filing offices; (ii) work with IACA and individual filing offices to develop, modify, and implement rules that will help filing offices perform their duties and serve their constituencies; (iii) communicate IACA's advice on how best to use the services of filing offices; and (iv) make recommendations on whether and how the UCC should be amended to make filing and searching easier, uniform, and more certain to yield the best results.

Report of the Subcommittee Chairs

The Joint Task Force on Filing Office Operations and Search Logic met at the ABA Annual Meeting in Chicago on August 1st to discuss the direction of the task force and initiatives for the coming year. The highest priority for the task force will be to provide any research or comment on debtor name and indexing issues requested by the Article 9 Joint Review Committee. Another initiative for the task force is to develop materials to help familiarize attorneys with the electronic UCC filing process and how it will affect legal practice. This issue will be of growing importance to attorneys because Colorado will become the first state to eliminate paper filing entirely in 2010. Other states are expected to follow that lead in coming years. Finally, the task force discussed an initiative to examine the impact of bogus UCC filings on filing office operations and provide input on the issue to IACA.
